Srinagar Court Rejects Bail Applications of Four Persons Arrested in Drug Case

Court of City Judge Srinagar on Saturday rejected three bail applications of four persons, who were arrested for possession of contraband (charas) by Srinagar Police in Kothibagh and Harwan areas of Srinagar city.

According to the news, Police Stations Kothibagh and Harwan were on a routine patrol when they arrested four persons – Mohammad Rafiq Sheikh, a resident of Sheikh Mohalla, Choudri Bagh, Nehru Park and Imran Hussain Khar, a resident of Khar Mohalla Nehru Park of PS Kothibagh, along with contraband (charas) weighing 80 grams in the form of three packets wrapped by corn leaves.

In another case, police station Harwan apprehended two persons with charas and their bail was also rejected by the court. As per the witnesses and the evidence on record, the commission of offences under sections 8/20 & 29 of NDPS Act were found established against the above accused persons.

APP Mohsin Khan, while opposing the bail application stated that the accused were selling the contraband (charas), especially among the school going/college going children at higher rates.

“The allegations against the accused persons’ offence were heinous in nature besides being non-bailable, as such instant bail application deserves outright rejection,” he said.

City Judge Srinagar Fozia Paul after hearing the arguments of both the Counsels held that drugs is an offence against the society and observed the involvement of the youth, particularly the school/college students into substance abuse at such an alarming rate in the Union Territory. “The application in hand needs to be rejected,” she said.

The court further observed that the accused persons, as per police reports, were involved in illegal trafficking of drugs and through a proper plan were selling the same in small quantities so that they would escape the clutches of the law. “Hence, the court outrightly rejected the bail of the above persons,” reads the judgment.
