AAP vs L-G fight: The Supreme Court on Thursday pronounced its verdict on the row between the Centre and the Delhi government over control of services in the national capital. The Delhi government will control administrative services on all aspects except land, public order and police, said the Supreme Court.
A 5-judge bench of SC led by CJI DY Chandrachud on Thursday ruled that L-G’s powers do not entitle him to interfere with the legislative powers of the Delhi assembly and elected government.
AAP vs L-G fight: The Supreme Court said that Delhi governance is like other states and L-G is bound by advice of Delhi government.
The Supreme Court said the case deals with the asymmetric federal model of government of India with a contest of power between Union and the Centre. “The issue is who will have control over services in UT of Delhi,” said SC.
The Supreme Court said that it does not agree with Justice Bhushan’s judgment that the Delhi government has no power at all over services.
“In the absence of law by Parliament, the Delhi Legislature and executive have powers to take decisions,” said SC in its verdict, adding that both Delhi and Centre have powers and that the elected government is the expression of the will of the people.
