ECI can hold Karnal bypoll as RPA section is ‘an exception & not a rule’: HC

Junking the petition seeking directions to set aside the Election Commission of India’s (ECI) notification announcing byelection for Karnal assembly seat, the Punjab and Haryana high court has held that Section 151A of the Representation of People Act (RPA), “is an exception and not a rule”.

The petitioner had sought directions to quash the ECI decision to Karnal bypoll, citing Section 151A of RPA that provides that no election can be held when the term of the assembled is less than one year
The Haryana assembly term lapses on November 3, 2024.
HC was of the view that the remainder term of the incumbent  CM Nayab Singh Saini being less than one year and the vacancy being available, no fault can be found with the impugned notification issued by ECI on Karnal.
