New Delhi, April 16 (Gulistan News) : During the ongoing hearing on the Waqf (Amendment) Act 2025, Chief Justice of India Sanjiv Khanna questioned the basis of waqf properties being declared by users. “What about waqf declared by the user?” the CJI asked, highlighting the ambiguity around the declaration process and legitimacy.

Responding to this, Solicitor General (SG) submitted that registration has always been mandatory. “Only registered. Nothing stopped registration… Registration was mandatory since 1925,” the SG said, adding that no waqf could claim legitimacy without being formally registered under the law.

The bench is hearing a batch of petitions challenging the constitutional validity of certain provisions of the Waqf (Amendment) Act. The matter will resume tomorrow at 2 PM.
