Bail application of drug peddler rejected by court

 

2nd Additional Munsiff Court on Friday Rejected the Bail application of a drug peddler who was arrested by Parimpora Police along with contraband substance at Shalteng Chowk last month.
Sources told that on 29″ November, 2022 a police party from Parimpora arrested a Bilal Ahmad Khanday R/o Chattabal Qamarwari along Ganja like substance which is approximately 250 Grams Accordingly FIR was lodged at Police Station Parimpora U/s 8/20 of NDPS Act.
Later the counsel for the accused had sought ball on the ground that possession of matter quantity of the contraband is a bailable offence and the investigation of the case is complete for which the charge sheet has been presented, as such there is no need to keep the accused under custody.
However, Ld APP Umer Mansoor strongly objected that the bail application is premature and the charges are yet to be framed against the accused.
Ld. APP during the course of the arguments said that menace of drug trafficking has risen with an alarming rate in the country and particularly in J&K. the problem of narco-terrorism is a challenging one.
Ahtzaz Ahmed, 2nd Additional Munsiff (JMIC) Srinagar in his Judgement said that granting bail in the instant case would defeat the object of the act and the accused involved in such an activity should not be granted the concession of the bail at this stage and there is a likelihood that the accused will again indulge in such activities if enlarged on bail.
He further said that the court has to be conscious of the dynamics of the drug trade prevalent in the UT of J&K and the cases of drug peddling are to be dealt accordingly to send a larger message to the society in general and the drug peddlers in particular. The prayer for grant of bail is accordingly rejected.
